Terms & Conditions and Acceptable Use Policy

Chicago3D.Net. - hereafter referred to as Chi3d - provides Internet web page and domain hosting, 3D virtual worlds, 3D Galaxys and 3D Universes. Chi3d has certain legal and ethical responsibilities consisting with the use of its server and equipment involved in these services.

Chi3d's general policy is to act as a reseller of internet presence. Chi3d has specific ethical concerns regarding the use of its computers detailed below. Chi3d reserves the right to suspend or cancel a customer's access to any or all services provided by Chi3d when we decide that the account has been inappropriately used.

Payment - Our preferred merchandising account for payment is Pay Pal Inc., an eBay owned company and licensed with the Illinois Department of Financial Institutions under the Transmitters of Money Act. Chi3d reserves the right to change prices at any time without notice. Any hosting payment, including 3D world hosting, that is past due by 10 days, can have the services suspended until payment is made and late charges may incur. Late charges start the day after the payment is due. Late charges are billed at $3.00 per day.

Abuse Notification - Any customer who violates Chi3d's policies in abusing any policy will not necessarily be notified, in rare cases, Chi3d has to temporarily deactivate and / or turn off hosting accounts without prior notification and / or reason. If no action takes place on customer side for initiating reactivation of hosting account and stop abusive usage of service, hosting account will be terminated permanently without refund. Chi3d will be the sole arbiter as to what is constituted as a violation of this provision.

Backups - It is the clients responsibility to keep backups of their httpdocs directory and any other directory the client may use. This also applies to web user accounts and 3d virtual world path customers. Losses of all types of data, or any other information stored on the Chi3D servers is not the responsibility of Chi3D and is not refundable. Chi3D does a complete server backup each week but can not restore any individual account without restoring the whole server at one time. It is Chi3D's policy not to restore the entire server because one customer lost their files due to any reason.

Spam - Commercial advertisements with e-mail unsolicited commercial advertisements are not allowed in e-mail (commonly known as SPAM or UCE) and will result in account suspension or cancellation.

Commercial advertisements are not welcome in most Usenet discussion groups and on most e-mail mailing lists. Inappropriate posting may result in account suspension or cancellation. See the newsgroup or mailing list's charter for whether advertising is allowed or not. "Spamming," or sending a message to many different off-topic newsgroups is particularly unethical and will be treated as such breach of this ethical policy.

Sending a message, especially an advertisement, to more than five or six recipients, is by itself spamming unless the individuals have specifically requested to be added to a mailing list on that topic. E-mail is a person-to-person medium, not a broadcast medium. Excepted are opt-in mailing lists where the recipients have explicitly requested to receive advertisements and have an opt-out option. Proof must be made that recipient has opted-in to receive advertisements and / or newsletters in case of complaint.

Cancellation
Chi3d reserves the right to cancel service at any time due to policy violations. If Chi3d institutes it's right of cancellation, no pro-rated fees will be refunded or credited as policies have been violated. Each customer is expected to use his/her account for the purpose of maintaining a web site only, with responsibility and respect toward other Internet users. Common sense is the best guide as to what is right and wrong, and it's the same guide we'll use when analyzing an event of bad behavior. Chi3d has the right to deny business to a customer. If Chi3d decides to stop providing customer service due to any of these reasons, the account will be terminated immediately. Any violation of policies which results in extra costs will be billed to the customer (i.e. transfer, space, server destruction, server damage, devastative behavior, hacking, phreaking, phroning, etc).

Customers can cancel service any time by sending email to sales@chicago3d.net. If the account was a subscription through Pay Pal, customer should also log in to their Pay Pal account and cancel the subscription for Chi3D Hosting. If client is within his 30-day money back guarantee period, (10 days for virtual world customers), Chi3d will credit 100% of the pre-paid money minus fees paid by Chi3D for accepting payment over the internet and previous waived set up fees. If client has exceeded 30-day money back guarantee period, ( or 10 days for virtual world customer), a refund cannot be applied in any case and due to any reason. Refunds will be honored within three weeks and be credit back to client via Pay Pal. It is the clients responsibility to provide a valid email address for use with Pay Pal.

Domain registrations are not part of the 30 day guarantee and are not refundable.

*****Specific Acceptable and Prohibited Use Policies*****

You may not sublet disk space without prior approval.

You may not sublet a unique IP for your domain.

Your account may not be used as a storage or backup facility. All files in your directory must be linked from publicly accessible HTML pages. (Exception to this rule is 3D paths for virtual worlds customers. The 3d paths must be hosted directly by Chi3D or the customer must subscribe to a Chi3D Ultimate package, only one world allowed to use path. A customer may also host their own path for their own world on the Premium plan providing Chi3D has the contract to host the world server. Although Chi3D allows path customers to use some of there storage space for a web site, this web site is only for promoting and giving information for the 3D world. A path customer can not use the webspace for any affiliate programs to earn money or automatically download a program to the viewers computer. Any exceptions to these rules must have prior approval from Chi3D. If the bandwidth usage is excessive and disrupts other Chi3D customers in any way, the path hosting service and or your account with Chi3D may be terminated.) Chi3d will be the sole arbiter as to what is constituted as a violation of this provision.

Server abuse
Any attempt to undermine or cause harm to a server or customer of Chi3d is strictly prohibited.

Unauthorized use of other people's accounts or computers
Chi3d will strongly react to any use or attempted use of an Internet account or computer without the owner's authorization. Such attempts include "internet scamming" (tricking other people into releasing their passwords), password robbery, security hole scanning etc.

Any unauthorized use of accounts or computers by a Chi3d customer, whether or not the attacked account or computer belongs to Chi3d, will result in action against the attacker. Possible actions include warnings, account suspension or cancellation and civil or criminal legal action, depending on the seriousness of the attack.

Adult Sites, That Place Adult Materials On Their Sites
Any type of pornographic materials, hate materials, adult materials (adult material is not necessary limited to pornography), racial materials, or unlawful practices are prohibited.

Chat Rooms
We do not allow clients to install their own chat rooms. Most chat rooms tend to be large system hogs and we cannot allow it as an account option. Parachat chat rooms do not apply to this rule. They are perfectly fine to install. Parachat software chat rooms are available from companies such as www.parachat.com or www.jpilot.com (remote Java chat) and do not put any system hogs on our servers. If you are purchasing a 3D virtual chat world, we can host the world server for you as a additional service.

IRC
We currently do not allow IRC or IRC bots to be operated on our servers.

Lawful Purpose
Chi3d reserves the right to refuse service to anyone. Customers may only use Chi3d's servers for lawful purposes. Transmission of any material in violation of any Federal, State or Local regulation is prohibited. This includes, but is not limited to copyrighted material, material legally judged to be threatening or obscene and material protected by trade secrets. Chi3d expressly forbids anyone from using Chi3d servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, adult OR pornographic material, or any other material which we deem to be objectionable, including, but not limited to, again - pornography, again - adult materials, satanic materials, and any and all materials of an adult nature. The designation of any materials as such described above is left entirely to the discretion of Chi3d management.

Indemnification
Customer agrees that it shall defend, indemnify, save and hold Chi3d and it's owner harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Chi3d, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Chi3d and it's owner against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Chi3d's servers; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from Chi3d's server.

Disclaimer
Chi3d and it's owner will not be responsible for any damages you or your business may suffer. Chi3d and it's owner makes no warranties of any kind, expressed or implied for services we provide. Chi3d and it's owner disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Chi3d, it's owner and its employees. Chi3D does not support the selling of any virtual or game items for real money by the Chi3d users. Chi3d reserves the right to revise its policies at any time without prior notification.

All Sub-Networks, resellers, clients, customers and dedicated servers of Chicago3D.Net must adhere to the above policies.

Failure to follow any term or condition will be grounds for immediate account deactivation.
